1. Introduction

Scale the Vibe, LLC ("Scale the Vibe," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect through our website at https://scalethevibe.com/ (the "Site"), how we use and share it, and the choices available to you.

2. Scope of This Policy

This Policy applies to personal information we collect from visitors to our Site and from individuals who contact us or schedule meetings with us — for example, prospective clients, business contacts, and other inquirers.

This Policy does not apply to client engagement data. In the course of providing services, we may access or receive information belonging to our clients, including source code repositories, cloud service provider environments, product telemetry, and other business or technical materials. Our handling of that information — including any personal information contained within it — is governed by the written agreement between Scale the Vibe and the client (such as a master services agreement, statement of work, confidentiality agreement, and, where applicable, a data processing addendum), and not by this Policy. Where we access personal information within a client's systems, we do so on the client's instructions and on the client's behalf.

3. Information We Collect

3.1 Information You Provide to Us

We do not require you to create an account on the Site, and we do not collect payment information through the Site.

3.2 Information Collected Automatically

When you visit the Site, certain information is collected automatically by our hosting infrastructure and analytics tooling, including:

  • IP address (which may be truncated or used only in aggregate)
  • Browser type and version, operating system, and device type
  • Pages viewed, referring URL, and the date and time of your visit
  • Interactions with the Site, such as clicks on our contact or scheduling links

3.3 Information We Do Not Intentionally Collect

We do not intentionally collect sensitive personal information (such as government identifiers, financial account numbers, precise geolocation, biometric data, health information, or information about racial or ethnic origin, religious beliefs, or sexual orientation) through the Site. Please do not include sensitive information in the free-text fields of our contact form.

4. Cookies and Similar Technologies

We use cookies and similar technologies on the Site, including:

  • Strictly necessary and functional technologies, which are required for the Site to load, render, and function correctly, including content delivery via Amazon CloudFront.
  • Third-party embedded tools. Our scheduling functionality is provided by Calendly, which may set its own cookies when you interact with the scheduling widget or link.
  • The Reddit Pixel. We use the Reddit Pixel, an advertising and conversion-measurement technology provided by Reddit, Inc. The Reddit Pixel allows us to understand whether visitors reached our Site from Reddit and whether they took actions such as submitting a contact form or booking a meeting. It may also enable Reddit to associate your visit with a Reddit account or advertising identifier and to build or refine advertising audiences.

Most browsers allow you to block or delete cookies through their settings. Blocking cookies may cause parts of the Site to function improperly. You may also be able to limit interest-based advertising through the privacy settings in your Reddit account and through industry opt-out tools such as the Digital Advertising Alliance's WebChoices tool (https://optout.aboutads.info/) and the Network Advertising Initiative's opt-out page (https://optout.networkadvertising.org/).

Global Privacy Control

Where required by applicable law, we honor the Global Privacy Control (GPC) browser signal as a request to opt out of the sharing of personal information for targeted advertising purposes.

5. How We Use Personal Information

We use the personal information described above to:

  • Respond to your inquiries and provide the information you request
  • Schedule, confirm, and conduct meetings and calls
  • Evaluate potential engagements and communicate with prospective clients
  • Establish, administer, and maintain business relationships, including contracting and invoicing
  • Operate, secure, maintain, and improve the Site
  • Measure the effectiveness of our marketing, including advertising placed on Reddit
  • Comply with legal obligations and establish, exercise, or defend legal claims

We do not use automated decision-making that produces legal or similarly significant effects concerning you.

6. Marketing Communications

If you contact us or book a meeting, we may follow up regarding your inquiry and about our services. You can opt out of non-transactional marketing messages at any time by using the unsubscribe link in the message or by emailing info@scalethevibe.com. We will continue to send you communications necessary to respond to your requests or administer an existing business relationship.

7. How We Share Personal Information

We do not sell your personal information for money. We share personal information only as described below.

Service providers. We share personal information with vendors that perform services on our behalf and are permitted to use it only for those purposes. Our current providers include:

Targeted advertising. Our use of the Reddit Pixel may constitute the "sharing" of personal information for cross-context behavioral advertising, or a "sale" or "targeted advertising" as those terms are broadly defined under certain U.S. state privacy laws. You may opt out of this activity as described in Section 4 and Section 9.

Legal and safety disclosures. We may disclose personal information if we believe in good faith that disclosure is necessary to comply with applicable law, regulation, legal process, or a governmental request; to enforce our agreements or terms; or to protect the rights, property, or safety of Scale the Vibe, our clients, or others.

Business transfers. If we are involved in a merger, acquisition, financing, reorganization, or sale of all or part of our assets, personal information may be transferred as part of that transaction, subject to this Policy or a successor policy providing comparable protection.

Professional advisors. We may share information with our attorneys, accountants, insurers, and similar advisors where necessary and subject to confidentiality obligations.

8. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy.

  • Contact form and scheduling inquiries that do not result in an engagement: retained for up to twenty-four (24) months from your last interaction with us, after which they are deleted or de-identified.
  • Contacts associated with an active or past client relationship: retained for the duration of the relationship and for up to seven (7) years afterward, to support contractual, tax, accounting, and legal-defense obligations.
  • Server logs and analytics data: retained in accordance with the default retention periods of the relevant service, typically no longer than thirteen (13) months.

We may retain information longer where required by law or where necessary to establish, exercise, or defend legal claims.

9. Your Privacy Rights

Depending on your state of residence — including but not limited to California, Texas, Colorado, Connecticut, Virginia, Oregon, and other states with comprehensive consumer privacy laws — you may have some or all of the following rights:

  • Right to know / access. Confirm whether we process your personal information and obtain a copy of it, along with information about the categories collected, the sources, the purposes of processing, and the categories of third parties to whom it is disclosed.
  • Right to delete. Request deletion of personal information we have collected from you, subject to legal exceptions.
  • Right to correct. Request correction of inaccurate personal information.
  • Right to data portability. Obtain your personal information in a portable, readily usable format.
  • Right to opt out of targeted advertising, sale, or sharing. Direct us to stop sharing your personal information for cross-context behavioral advertising or targeted advertising, including via the Reddit Pixel.
  • Right to limit use of sensitive personal information. We do not collect or use sensitive personal information for purposes that would require this right; nonetheless, you may contact us with any concerns.
  • Right to non-discrimination. We will not deny you services, charge you a different price, or provide you a different level of service because you exercised a privacy right.

How to Exercise Your Rights

Email info@scalethevibe.com with the subject line "Privacy Request" and tell us which right you wish to exercise. We will need to verify your identity, typically by confirming that you control the email address associated with the information we hold, and may request additional information if we cannot reasonably verify you. We will respond within the time period required by applicable law, generally forty-five (45) days, with an extension where permitted.

Authorized agents. You may use an authorized agent to submit a request on your behalf. We may require written proof of the agent's authority and may require you to verify your own identity directly with us.

Appeals. If we decline to act on your request, you may appeal that decision by replying to our response or emailing info@scalethevibe.com with the subject line "Privacy Appeal." We will respond to your appeal within sixty (60) days. If your appeal is denied, you may contact the attorney general of your state of residence. Texas residents may contact the Office of the Texas Attorney General at https://www.texasattorneygeneral.gov/.

California-Specific Disclosures

In the preceding twelve (12) months, we have collected the following categories of personal information as defined by the California Consumer Privacy Act: identifiers (name, email address, IP address); commercial information (inquiries about our services); internet or other electronic network activity information (browsing and interaction data); and professional or employment-related information (company name and role, where you provide it). The sources, purposes, and recipients of this information are described in Sections 3, 5, and 7. We have not sold personal information for monetary consideration. We may have shared personal information for cross-context behavioral advertising as described in Sections 4 and 7. We do not have actual knowledge of selling or sharing the personal information of consumers under sixteen (16) years of age.

10. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These include encryption of data in transit, access controls limiting access to personnel who need it, multi-factor authentication on business systems, and vendor selection practices that consider security posture. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

11. Children's Privacy

The Site is directed to businesses and business professionals and is not intended for children. We do not knowingly collect personal information from anyone under the age of eighteen (18). If you believe a child has provided us with personal information, please contact info@scalethevibe.com and we will delete it.

12. Third-Party Links and Services

The Site may contain links to third-party websites and embedded third-party services, including Calendly. We do not control those third parties, and their handling of your information is governed by their own privacy policies. We encourage you to review them.

13. Where Your Information Is Processed

Scale the Vibe is based in the United States, and the personal information we collect is processed and stored in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. The Site and our services are directed to businesses in the United States and are not offered to individuals in the European Economic Area or the United Kingdom.

14. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the "Last Updated" date above. If we make material changes, we will provide additional notice, such as a notice on the Site. Your continued use of the Site after the effective date of any change constitutes acceptance of the updated Policy.
